Terms of Use for Warburg Library Commons

1.      General

https://commons.warburg.sas.ac.uk. (the “Site”) is operated by the University of London. The aim of the Site is to disseminate information and research to scholars, educators and the public. The use of the Site and its Contents is subject to the following terms and conditions and all applicable laws. By using the Site or any of its Content, you confirm that you accept and agree to be bound by these Terms of Use and all applicable laws. If any of these Terms of Use are unacceptable to you, do not use the Site.

 

2.      Changes to Terms of Use

We may amend these Terms of Use from time-to-time without advance notice. Every time you wish to use the Site, please check these Terms of Use to ensure you understand the Terms of Use that apply at that time. These Terms of Use were most recently updated on 14 July 2019.

 

3.      We may suspend or withdraw the Site

The Site is made available free of charge.

We do not guarantee that the Site, or any Content on it, will always be available or be uninterrupted. We may suspend, withdraw or restrict the availability of all or any part of the Site for organisational and operational reasons.

You are also responsible for ensuring that all persons who access the Site through your internet connection are aware of these Terms of Use and other applicable terms and conditions, and that they comply with them.

 

4.      Use of Content deposited in the Warburg Library Commons

“Content” can include, but is not limited to, publications, conference proceedings, book chapters, monographs, theses, various forms of research data (video recordings, spreadsheets, images etc.) and presentations.

Content is made available on the Site on terms agreed with depositors of the Content so that as an end user you may use the Content only if you abide the licence or other terms under which it has been released. These terms may be the terms of a specific Creative Commons Licence or terms as specified in the coversheet to an item of Content.

Unless indicated otherwise, Content made publicly available on the Site are protected by copyright with all rights reserved.

 

The Content has been deposited to enable teaching, research, and other non-profit educational activities. Unless otherwise specified in the coversheet attached to an item of Content, you may use the Site and its Content only for non-commercial, research, educational, or related academic purposes.

Such uses include personal study, distribution to students, research and scholarship (including computational research uses such as data and text-mining, citation-extraction, or cross-referencing) as long as you do not sell the Content or sell advertising on any page on which the Content is displayed. If you make an item of Content available to others, you shall do so in accordance with the terms of the rights granted pursuant to the particular item of Content, or at a minimum, and provided a valid Creative Commons licence is attached to the Content, you will retain with the Content its title, the name of the author(s), a reference to these Terms of Use, any copyright notice included on the original, and any metadata associated with the original. You may not make commercial use of a facsimile of the published version of an article that may be posted in Warburg Library Commons under these open access terms, unless the publisher so permits.

You will not make any translation, adaptation or other derivative work of an item of Content except as authorised under English law, and only if the Content has been licensed by the author(s) under a Creative Commons licence that makes provision for this. You may not sublicense or otherwise transfer your rights in an item of Content, unless specifically authorised by the copyright licence granted to the item of Content and if the Creative Commons licence used by the author(s) makes provision for this. You will only make Content available to others for use by them under these Terms of Use.  

Nothing in these Terms of Use or on the Site will be construed as granting you any right or licence to use any trademarks, service marks or logos displayed on the Site, including, but not limited to, those of the University of London or the Warburg Institute. 

5.      Special Permissions

 

Warburg Library Commons does not have the authority to grant or deny special permissions to use images or other Content found on the site beyond those uses that are specifically described in these Terms of Use or as noted specifically on individual items of Content. Warburg Library Commons staff are not able to undertake copyright investigations on behalf of Site users.

 

6.      Third Party Links

Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.

We have no control over the contents of those sites or resources.

7.      Fair Dealing and Other Lawful Uses: Nothing in these Terms of Use is intended to restrict or limit you from making uses of Content that, in the absence of rights granted hereunder, would not infringe or violate anyone's copyright, trademark or other rights. To the extent permitted by law, adaptation of Warburg Library Commons Content to enable use and access by persons with disabilities is encouraged.

 

8.      Reserved Rights and Obtaining Permissions

 

All rights in the Site and the Content that are not expressly granted are reserved. You agree to use the Site and the Content only in ways that comply with copyright and all other applicable laws, as well as with these Terms of Use, and that do not infringe or violate anyone's rights. If you wish to make any use of the Content that requires authorisation under copyright, trademark or other rights, you agree to obtain all necessary permissions. You are responsible for determining whether permission is needed to make any use of the Content that you wish to make.

 

9.      Our responsibility for loss or damage suffered by you

To the extent permitted by law, we exclude all implied conditions, warranties, representations or other terms that may apply to our Site or any content on it.

We will not be liable to you for any loss or damage, in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with use of, or inability to use the site, or use of or reliance on any content displayed on the site, nor for loss of profits, business or revenue, loss of anticipated savings, loss of business opportunity, goodwill or reputation of any indirect or consequential loss or damage.

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

10.   We are not responsible for viruses and you must not introduce them

 

We do not guarantee that our Site will be secure or free from bugs or viruses.

 

You are responsible for configuring your information technology, computer programmes and platform to access our Site. You should use your own virus protection software.

 

You must not misuse our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.

 

11.  How to contact us

If you wish to contact us about the Content uploaded onto the Site, including if you believe that an item of Content infringes intellectual property rights, please notify us at Warburg.repository@sas.ac.uk

12.  Applicable Law and Jurisdiction

These Terms of Use, their subject matter and formation will be governed by the laws of England and Wales, and in agreeing to these Terms and Conditions you submit to the exclusive jurisdiction of the courts of England and Wales in the event of disputes or claims that arise from or relate to your use of the Site or its Content.

13.  Termination

The permissions granted to you will terminate automatically upon any breach by you of these Terms of Use. If we take down or otherwise cease to make a work available as an item of Content, the permission granted to you hereunder to use that Content thereafter will terminate at that time. Warburg Library Commons is maintained as a scholarly and educational resource by University of London, which may be modified or terminated by the University in its sole discretion.
